The Whistleblower Protection Act is here! But what does it mean for you? The Whistleblower Protection Act, based on the EU Whistleblower Directive, provides for the protection of individuals who report violations in certain areas of companies and the public sector. This includes state, regional and municipal authorities, institutions, offices and subordinate legal entities under public law that have 50 or more employees. The Whistleblower Protection Act was approved by the Bundesrat on May 12, 2023. The requirements are already known from the EU Directive. The Whistleblower Protection Act is to come into force in mid-June 2023.
Infringements against the implementation of European legal standards from several areas of law can be pointed out in the future via whistleblowing and a corresponding whistleblower system. However, information security and data protection concerns, such as the intentional disclosure of sensitive information and trade secrets (for example, on patents, business strategies or balance sheets), will also fall under the directive as violations.
